TERMS OF SERVICES

LIVE2D MODEL ART TOS. That they are above the age of 18 and assume full responsibility for any money exchanged for this service.. That they own the rights to use any designs provided to me for the commissioned work.. That they will not resell the Live2D model or any part of it I created (without my permission), they will not redistribute the files, or claim the artwork as their own.. That they will not edit or add onto the model artwork without my permission.. That they will not hire or otherwise have another artist edit or add onto the model artwork without my permission. A small exception can be made for the model rigger to clean areas that I missed or adjust the model cutting as needed for their work process.. That I retain all the rights to my work, which include but are not limited to the right to distribute, reproduce, copy and/or use the image as a sample for sales or self-promotion. If you would like me to refrain from posting the artwork before your debut, please notify me of this.. Unless previously discussed or confirmed in writing, I reserve the right to post all commissions to my social media for portfolio purposes. A courtesy request for posting will be sent to a commissioner prior to my posting of the work. If no response is provided or contact with the commissioner has lapsed an eligibility period of 6 months, the work will be posted without further confirmation. This includes any Work in Progress Commissions where contact with the client has been lost.. That they will credit me clearly as the artist (ideally with a link to my social media).. That they recognize that slots can only be given via an application made using my application form, and slots are not first come first serve. And that I retain the right to decline any commission requests that I feel aren’t something I’m willing to do for either personal or practical reasons.. That they are aware the commission example prices are aimed towards the commercial usage incurred by individual “indie” clients. If you represent a talent company or corporation, you will be subject to my non-discounted rates according to the scale of the company (up to 2x the example prices).. That they will not use/upload/sell any version of the commissioned work as non-fungible tokens (NFTs) anywhere, nor will they feed it into any AI datasets.

▾Commercial use▾. All of my Live 2D Model art commissions are by nature for commercial use and may thus be used on for-profit projects as is agreed upon between myself and the commissioner. The fee for commercial use is included in the price of each commission, but may be subject to change if I find a degree of commercial use to be particularly serious, I will notify you in advance should this be the case.. I retain all the rights to my work, which include but are not limited to the right to distribute, reproduce, copy and/or use the image as a sample for sales or self-promotion. If you would like me to refrain from posting the art, please notify me of this.Please credit me for the art!

▾Refunds and cancellation▾

. If the client wishes to cancel the commission during the rough sketch stage I will retain up to 20% of the quoted base model price to pay for the work done (I will determine the exact amount based on the work I have done), anything already paid to me in excess of this amount will be refunded to the client.. If the client wishes to cancel the commission during the clean sketch stage I will retain up to 40% of the quoted base model price to pay for the work done (I will determine the exact amount based on the work I have done), anything already paid to me in excess of this amount will be refunded to the client.. If the client wishes to cancel the commission during the Final render and basic cutting stage I will retain 80% of the quoted base model price to pay for the work done (I will determine the exact amount based on the work I have done), anything already paid to me in excess of this amount will be refunded to the client.. If the client wishes to cancel the commission during the Final cutting and symmetry tool removal stage I will not issue a refund unless special circumstances apply.

GENERAL ART TOS. I have the right to refuse any commission(s) I am not comfortable with doing.. I have the right to issue a refund at any time or stage if I do not feel comfortable.. I have the right to publish my commissions on my social medias.. The client may post their commission wherever they want. Credit is appreciated.. Commissioned artwork is for personal use ONLY. Please contact me for commercial usage.. I reserve all rights to my artwork.. Clients can make changes to their commission AS LONG AS they do not make profit/ claim as their own work.. Clients may use their commissions as designs/ prints / etc. AS LONG AS they do not make profit / claim as their own work.. No one is allowed to mint my artwork as a NFT (Non Fungible Token). My commissioned and pre-existing work, cannot be minted into an NFT by a commissioner nor anyone else.. All payments are made via PayPal invoice (USD).. Payments must be in full after sketch is complete.. I will not continue your commission if not payed for after sketch.. If payment is not received within 24 hours of the invoice being sent, the commission will be cancelled, BE prepared when commissioning me.. Refunds are only given if I can no longer work on the commission.. If you are given a refund, you do NOT have rights to any of the work done on the commission. I have the rights to re-purpose the commission.. WIPs are provided throughout whole process of commission and live on my Trello.. I will make edits to a final product, such as missing markings or design errors, if it was my error.. If the product is wrong due to the reference being vague/incorrect, I will not edit the final product. Provide clear/proper references!. Do not commission another artist to edit my work without my permission.. I will not hold commission slots.. Please make sure you are completely satisfied with the sketch before I continue the commission.. I will not draw in another user's style. I will only draw in my own style.

> Turn around: I aim to finish commissions within the same month they were accepted after payed for. But at times it may take up to 1 month or more to finish depending on your slot number and my life/work schedule. Harrassing and rushing me will immediately resort to a refund and cancel on your slot.
